PUBLIC NOTICE
There have been and there still are complaints by motorists about cheating
at the retail outlets by pump attendants who tamper and adjust dispensing
machines in connivance and collusion with pump mechanics, after having
been sealed and certified by the Ghana Standards Board, for financial gains.
The action by these attendants has caused a myriad of problems to
motorists. Notable among these is the under-delivery of products purchased
by motorists at the retail outlets.
PUBLIC NOTICE – NPA. N. 004
A. The National Petroleum Authority was enacted by an Act of Parliament Act 2005, (Act 691) and given Presidential Assent on 14 June, 2005. Section 30 of the National Petroleum Authority Act, 2005, Act 691 stipulates that no person shall construct or operate a petroleum product retail station, among others, without the prior written authorization of the Authority. In this regard, any individual or OMC that undertakes to construct and operate a petroleum product retail outlet is, as required by law, to apply for a Construction Permit from the Authority.

The National Petroleum Authority wishes to refer all operators of Bulk Road Vehicles (BRVs) to the Public Notices of October 07, 2002 and May 10, 2006 which spelt out in detail requirements for the registration and licensing of all BRV’s engaged in bulk transportation of petroleum products in the country.

Requirements for a Permit to Construct a Petroleum Product Pipeline
(1) An application for a permit to construct a petroleum product pipeline shall be accompanied with the following, that is,
a) a fee of US$10,000 or the cedi equivalent
b) a statement indicating
(i) Services to be rendered by the pipeline
(ii) Specifications of the pipeline
(iii) Characteristics of the fluids to be conveyed through the pipeline, and
(iv) Total estimated cost of construction of the pipeline project.
Documentation Requirements for the Grant and Issue of Oil Trading Licenses (Registration) to Oil Trading Companies
For the grant and issue of a license to engage in any business or commercial activity relating to the petroleum sector, such as the supply of crude oil and petroleum products, Section 12 of the NPA Act, 2005 (Act 691) stipulates that a license may be granted to:
a. A citizen of Ghana; or
b. A body corporate registered under the companies Code, 1963 (Act 179) or under any other law of Ghana; or
c. A partnership registered under the Incorporated Private Partnerships Act, 1962 (Act 152).
d. A foreign individual or foreign company in a registered joint venture with a citizen of Ghana or a Ghanaian company
REGISTRATION FORM FOR CRUDE OIL AND PETROLEUM PRODUCTS SUPPLIES
1. Name of Company:
LPG CONSTRUCTION PERMIT
The following are the requirements for the grant and issue of a permit to construct an LPG filling plant:
i. A letter of sponsorship from an existing oil marketing company or LPG marketing company, in the case where the LPG filling plant is being constructed by an individual.
ii. Proof of Title to the land/Indenture
iii. A Fire Permit signed by the Regional Fire Officer evidencing that arrangements proposed for the prevention and fighting of fire coupled with good housekeeping practices at the site are satisfactory.
APPLICATION FOR A CONSTRUCTION PERMIT FOR A PETROLEUM PRODUCT STORAGE, BULK SALE AND DISTRIBUTION DEPOT
Any application for a permit to construct a petroleum product storage, bulk sale and distribution depot (Depot) shall be submitted to the National Petroleum Authority giving details of the proposals and any information that may be relevant to the project.
2. If, after the permit to construct the Depot has been granted and the execution of the works has not commenced at the expiry of twenty four (24) months from the date on which permit was granted, or at the expiration of any extension of that period which the Authority may allow, the permit shall cease to have effect.
