A. The NATIONAL PETROLEUM AUTHORITY wishes to inform the general public, specifically industries, companies, and individuals who are Bulk Consumers in the petroleum downstream sector, on provisions under the National Petroleum Authority Act 2005, (Act 691) and the requirements for obtaining a license.
Section 11(1)
A person shall not engage in a business or commercial activity in the petroleum downstream industry unless that person has been granted a license for that purpose by the Authority.
Section 12
A license under this Act may only be granted to:
a. a citizen of Ghana; or
b. a body corporate registered under the Companies Code, 1963 (Act 179); or
c. a partnership registered under the Incorporated Private Partnerships Act, 1962 (Act 152); or
d. a foreign individual or foreign company in a registered joint venture
Section 32(1)b
A person, other then a person licensed under the Act, shall not be in possession of a petroleum product in quantities unreasonably in excess of that person’s immediate requirement.
B. CLASSIFICATION OF BULK CONSUMERS
The following are the classification for bulk consumers of Petroleum Products.
a. A company with diesel storage facilities with capacity of 9,000 litres and above.
b. A company with gasoline storage facilities with capacity of 9,000 litres and above
c. A company with kerosene storage facilities with capacity of 9,000 litres and above
d. A company with LP gas storage facilities with capacity of 5 tonnes and above.
C. REQUIREMENTS FOR OBTAINING A PETROLEUM PRODUCT BULK CONSUMER’S LICENCE.
a. A letter of sponsorship from an existing Oil Marketing Company/ LP Gas Marketing Company.
b. A Corporate Environmental Policy culminating in the grant and issue of an Environmental Permit by the EPA.
c. Ghana National Fire Certificate.
d. Factories Inspectorate Department (Certificate of Examination)
e. Calibration certificates covering the storage tanks
f. In case of LPG tanks, Non Destructive Test (NDT) certificates.
D. A provisional license will initially be granted and issued to all applicant companies requiring Bulk consumer status.
A provisional licence will be valid for a calendar year or part thereof and expiring on 31 December of the relevant year.
Under this licence and prior to the issuance of the final licence, the Authority will monitor and ensure full compliance with safety and environmental regulations including purity of products.
